2nd Div 29 May 1991. A lease was terminated by the plaintiff landlord (C), as D had failed to pay rent on time, despite a written warning. C also raised an action of declarator of irritancy. This was countered by the tenant with the assertion that late payment had been accepted previously and that C`s letter amounted to oppression, a defence which was rejected by the court.
