It was held that there was no enforceable right to compensation, where there had been a lapse of six years between the date of the complsory purchase and recourse to the Lands Tribunal to settle compensation under Town and Country Planning (Scotland) Act 1972 schedule 24 para 36. An imperfect right to compensation could exist but only on the basis of voluntary agreement between the parties.
