CA 20 November 1991. An appeal by an intended tenant, who had become insolvent, against a claim for specific performance was dismissed. The appellant contended that the court should have regard to the statutory scheme for the distribution of assets of insolvent companies but the court held that this procedure only came into effect when a company goes into liquidation.
