CA 20 December 1991. It was held that a s146 notice served on tenants, to whom the lease had been assigned without the landlord`s consent, was valid and that the tenants were entitled to relief from forfeiture. The court had to decide the basis of relief since new tenants, unaware of another`s claims on the property, were in possession; the tenants became immediate reversioners on the new tenants` lease.
