QBD 24 May 1991. An appeal under Tribunals and Inquiries Act 1971 was successful in contesting the approach by the rent assessment committee to determining a fair rent. It was held that the committee had failed to use the evidence of comparable lettings and that it was not for the committee, having determined the fair market rent, to decide if such a rent was reasonable.
