In Foy v Dacorum BC and others , CA 1 May 1990, it was held that the evidence before the court showed that a triangle of land had been part of the highway since 1799. Land could be part of the public highway even if it was not maintained as such and metalled . Whether the land is part of the public highway is a question of fact.
