Examines a recent decision, "Equity and Law Home Loans Ltd v Prestidge" 1992, where the mortgagee sought possession of the property, which had been remortgaged unbeknown to the second occupant of the property. However, the second occupant, although having an interest in the property by virtue of an initial contribution to its purchase, having consented to the first mortgage was considered to have consented to the second mortgage.
