In "Mohamed v Kensington and Chelsea Royal RBC", CA 30 March 1995, it was held that a person who occupied temporary bed and breakfast accommodation in a hotel while the housing authority investigated his application, as a homeless person in priority need, is not entitled to the protection of the Protection from Eviction Act 1977.
