Brother succeeds in securing tenancy

In "Waltham Forest LBC v Thomas", HL 18 June 1992, it was held that in order to qualify for succession to a secure tenancy under Housing Act 1985 s87 a successor must have resided with the deceased tenant during the 11 months prior to the tenant`s death. There was no requirement that that whole period of residence be in the house to which succession is claimed.
