OFC 31 January 1992. Dispute arose after the property owner (K)`s failure to pay the plaintiff (C) for refurbishment carried out and certified by the architect as complete. C issued a writ to recover his due. K`s defence was that the work was defective and that furniture had been culpably removed. Howover, this challenge had not been made within the stipulated 21 days after the final certificate and so the ruling fell in C`s favour.
