A report commissioned by developer K from the defendant cited an open market value for the proposed purchase together with a value if planning permission for development was granted and a likely value on realisation. When K became bankrupt and the property sold for a smaller figure, A sued E for negligence. QBD upheld the defendant`s method of valuation.
