In Associated British Ports v C H Bailey plc ChD 14 October 1988 it was held that the landlords of the demised premises were entitled to proceed with the forfeiture of the lease for breach of repairing covenant because at least one of the grounds in Leasehold Property (Repairs) Act 1938 s23 had been satisfied.
