In R v Lancashire County Council and Another, ex parte Telegraph Service Stations Ltd QBD 20 June 1988 the court upheld an application for judicial review of the council`s actions on the grounds that in selling surplus land , they were in breach of Local Government Act 1972 s 123(2) as they must be regarded as trustees bound to obtain the best price on behalf of the ratepayers.
