In "Gillingham BC v Medway (Chatham) Dock Co Ltd and others", QBD 31 July 1991, it was held that since planning permission for a development can alter the character of a neighbourhood, a claim in public nuisance must be judged by reference to the character of the neighbourhood after the development and not as it was previously.
