Discusses the implications of the recent HL ruling "Kirklees BC v Wickes Building Supplies Ltd" 3 July 1992 which held that local authorities should not be required to give an undertaking for damages as a condition of obtaining an injunction under the Local Government Act 1972 s222 restraining the applicants from opening their stores on Sundays contrary to the Shop Acts 1950 s47.
