"R v Northumbrian Water ex parte Able" QBD 1 December 1995. N served a notice to treat on A but withdrew the notice following A`s claim for compensation. A applied for judicial review of whether N were entitled to withdraw once they had entered into possession. "Held" that N could withdraw notice to treat under Land Compensation Act 1961 s31(1) even though it could not under s31(2).
