In Dean v Ainley , (also cited as Alan Dean v Mary Ainley ), CA 14 July 1987, it was held that the purchaser of a house was entitled to substantial damages for the vendor`s breach of a specific term in the contract of sale to remedy damp, notwithstanding that the effect of the vendor doing the work would not have achieved the desired result of providing dry premises
