"Surrey CC and another v Bredero Homes Ltd" CA 7 April 1993. The councils were awarded only nominal damages for the breach of covenant by the developer, who developed the transferred land to a greater density than the covenant allowed. At common law the damages should compensate the victim for loss not claw back for the victim benefits gained by the wrongdoer; the councils suffered no loss and thus received only nominal damages.
