CA 15 April 1992. An appeal against the claim for possession under Rent Act 1977 Case 9 of Pt1 Sch15 was successful. The appeal court found that the transfer of the property from parents to son, even though it contained covenants by the appellant with the building society, was a gift; the appellant did not purchase the property and was not landlord of the property.
