"Dowling Kerr Ltd v Scott" CA 7 November 1996. On appeal, held that the plaintiff estate agent was not entitled to commission under the sole selling rights agreement. There had been no sale within the meaning of clauses 3 & 6 as the lease granted to the tenant had no capital value.
