Linden Gardens v Lenesta Sludge Disposals and others , HC December 1990, considered whether an assignee could enforce the leaseholder`s right to claim damages for defective works and whether the words `neither the employer not the contractor shall without the written consent of the other assign this contract` prevented, without consent, an assignment of a cause of action pursuant to the contract or simply the assignment of the contract itself.
