In Watts and another v Morrow CA 30 July 1991, the damages awarded to the plaintiff were reduced following an appeal by defendant surveyor on the grounds that a contract by a surveyor to provide a structural survey is not a contract to provide peace of mind or freedom from distress. Therefore, damages are recoverable only for distress caused by physical consequences of the breach of contract. Summary available.
