QBD 12 May 1994. The SoS refused conservation area consent to K who had sought permission for the demolition of two bridges on land within a conservation area on the grounds that the proposed replacement schemes would not preserve or enhance the appearance of the conservation area. K challenged the decision on the grounds that new works did not require conservation area consent under Listed Buildings and Conservation Areas Act 1990 only the demolition work did. Application dismissed; in deciding whether to grant or withhold conservation area consent, the nature and appearance of a replacement structure was a relevant consideration.
