It was held in British Waterways Board v Anglian Water Authority and another ChD 12 April 1991, dismissing an action by the plaintiff, that the gravitational loss of water from a canal which replaced water drawn from a connecting outfall channel under a licence granted to the occupier, was not an abstraction from inland water as defined by the Water Resources Act 1963 s135 .
