In "Scottish and Newcastle Breweries plc v SOS for Environment and another" CA 24 February 1992, an appeal against refusal for planning permission for a green belt development, it was held that the SOS was not satisfied that the proposed development could not be carried out on non-green belt land that he was not required to carrying out a further balancing exercise to consider the degree of damage to the green belt that the development would cause. Appeal dismissed.
