LT 26 May 1995. The claimant(H) had received a contribution to repair costs from the defendant(B) following damage to his property from mining subsidence. H claimed that this did not include costs for employing expert advice on repairs; B maintained that the sum originally offered and accepted was in full and final settlement of all costs. Claim dismissed as claimant had not raised issue of extra costs for professional fees when accepting the original offer that was clearly intended to be a full and final settlement.
