LT 2 December 1994. The value of rights to place, repair and maintain electricity lines accross the claimant`s land, as set out in a compulsory purchase order, had been agreed by the parties at £150. The issue was the diminution in value of the property resulting from the compulsory purchase order; put by the claimant at 15-20% and the defendant at 1-2%. The claimant related his figure to intruding electric fields, effect of humming noise, personal risks to minors, and inhibiting future development. The defendant related their figure to effect of overhanging cables and pylon on view from the property. Held: compensation for injurious affection at £4,000 and £150 easement over land for lines and fittings; their presence not substantially affecting diminution in value.
