In Lord Advocate v Dumbarton DC and same v Strathclyde RC HL 30 November 1989, it was held that a statute which imposes legal obligations or restraints on persons or in respect of property is not binding upon the Crown unless the statute says so expressly or by necessary implication in a case which involved closing of a section of a major road for the erection of a security fence around a submarine base .
