Discusses "Stewart Gill Ltd v Horatio Myer & Co Ltd" 1992, a decision which found that where a term in a contract prevents payment or credit against the price claimed, it is `prima facie` unreasonable and the burden of proving that the term is reasonable for the purpose of the Unfair Contract Terms Act 1977 s13, rests on the plaintiff.
