"North Wiltshire DC v SoS for the Environment and another" CA 15 April 1992. In considering an appeal by a local authority against a planning inspector`s decision to refuse planning permission for a house, it was held that a previous planning appeal decision which is indistinguishable from the case under consideration must be a material consideration to be taken into account by a planning inspector. Appeal allowed.
