QBD 20 December 1991. Appeal against a planning authority`s refusal to grant planning permission to British Railways Board for residential development with road access across land owned by Hounslow LBC. Held that the SoS had no power to compel any party to enter into a planning agreement (including the planning authority) and conditions which would not have been effective to secure the ecological future of the land.
