LT (REF/80/91) 31 March 1992. Concerns the compensation payable by the council (H) to a claimant (C) on the compulsory purchase of C`s freehold of two town centre sites for a redevelopment scheme. C`s valuation was based on an assumption that the combined site could accommodate an office development with basement, ground floor car park and three upper floors. H contended that this would create unacceptable overlooking unsuitable outside the commercial area. Another objection was that of rights of light. C arrived at a valuation of £2,965,000. It was "held" that the compensation payable by H to C was £2,450,000. Reasons for the decision are set out in detail.
