In "Overseas Investment Services Ltd v Simcobuild Construction Ltd and another" QBD 22 October 1993, it was held that an agreement made pursuant to Highways Act 1980 s38 created a public right which was an overriding interest within Land Registration Act 1925 s70(1)(a).
