In Cooke v Adatia and others , QBD 1 November 1988, it was held that where the only evidence tendered on an information alleging contravention of a requirement of a notice served under Control of Pollution Act 1974 s58 was that of a senior environmental health officer , justices erred in holding that there was no evidence to prove that a nuisance had been caused to occupiers of any residential property.
