"Berkowitz v MW (St Johns Wood) Ltd and others" QBD 10 June 1993. Nominal damages were awarded to a vendor, who claimed that the agents had failed in their duty by not checking a purchaser`s references, although the vendor`s solicitors had pointed out the inadequacy of the references and had requested from the agent correct references. The purchase was uncovered as a fraudulent transaction. The agents were held to be entitled to commission.
