A loophole in an auctioneer`s standard terms for commission has been highlighted in "Fairvale Ltd v Sabharwal", where the agents introduced their clients to a purchaser after the auctio where there had been no sale. The introduction brought about a sale but not within 28 days of the abortive auction and so commission was not owed to the agents.
