"R v Mill Lodge Properties Ltd and another, ex parte Chichester DC" QBD 27 October 1992. An application by the planning authority against the award of costs because the authority had failed to determine a planning application was dismissed. The inspector was found to have used the correct test for awarding costs and had followed guidance issued in DoE Circular 2/87.
