"Omar Parks Ltd v Elkington"; "Ron Grundy (Melbourne) Ltd v Bonehevo" CA 8 July 1992. The court considered the construction of Mobile Homes Act 1983 schedule 1 para 5 and found that the site owner, in terminating an agreement under this paragraph to position a mobile home on a protected site, must satisfy the court that the occupier is not occupying the home as a sole or main residence at the time of the court hearing as opposed to the time when the owner applies to the court.
