The discussion about negligence claims in tort or in contract is furthered by a recent case, "Hiron v Pynford South Ltd" 1991, where the tortious and contractual duties coincided so that a tortious obligation would only have given the plaintiffs a longer period, within which to sue, and if this was a condition required it could have been added into the contract. Therefore, it seems an action in tort is not always acceptable.
