It was held in R v Plymouth City Council and Another, ex parte Freeman that a lodge in a country park fell within the definition of open space in the Town and Country Planning Act 1971 S290(1) , and therefore, the grant of a lease of the lodge without advertisement , in accordance with S26 (2) of the Town and Country Planning Act 1959 , as substituted, was void.
