Surrey CC and another v Bredero Homes Ltd - 1993 - Estates Gazette (1993) 03 EG 112-119 (6) .

ChD 22 November 1991. It was held that the housebuilder was in breach of covenant developing a site to a greater density than planning permission allowed but the vendor was only entitled to nominal damages since the principle of damages for breach of covenant should be based on loss to the plaintiff, not the defendant`s profit.
