In " Mansukhani v Sharkey" CA 15 April 1992, it was held that the transfer of a leasehold flat from parents to child in consideration of mutual love and affection by subject to a covenant by the child to keep up the mortgage payments, was not a transfer by purchase for the purposes of case 9 of Part 1 of Schedule 15 to the Rent Act 1977.
