In "Regalgrand Ltd v Dickerson and another" CA 12 November 1996 the appellants claim agains the reduction in the level of damages under Housing Act 1988 s27 was dismissed. Their personal conduct in withholding payments and carrying out their intention on leaving met the conditions of the 1988 Act.
