Bromley LBC v SoS Environment and another

Bromley LBC v SoS Environment and another - 1994 - Property and Compensation Reports (1994) 68 PCR 493-503(11) .

QBD 13 January 1994. A set of buildings previously used for agricultural purposes and now redundant were being used as offices and for storage of scaffolding and building materials. B issued two enforcement notices, one requiring cessation of office use and one the removal of the scaffolding and other materials. An Inspector quashed the notices on appeal and granted permission for use of the yard for non-agricultural purposes. B appealed. This was allowed on the grounds that the Inspector had wrongly made a decision about the building without regard to the open land and had not considered whether it was appropriate in a rural area within the meaning of PPG2 para 13.
