"Dukeminster (Ebbgate House One) Ltd v Somerfield Property Co Ltd (formerly Gateway Properties Ltd), ChD 14 March 1996. Sale and leaseback of a retail distribution warehouse, where an upwards-only rent review was provided for. Landlord entitled to choose notional premises within 35-mile radius. Dispute over failure to specify where, within the radius, the premises were to be assumed to be located. Rent review clause constructed in plaintiff landlord`s favour but rectification refused.
