Gray v Brown - 1993 - Estates Gazette (9307) 20 February 1993, 97-98(2) .

CA 21 October 1992. At first instance the non-resident landlord (G) had claimed and been granted an order of possession on the grounds that the oral tenancy agreement was a restricted contract under the Rent Act 1977 s21. Relying on the same Act, B appealed, claiming that his was a protected tenancy. The court agreed as G had not reserved himself the right to future occupation when settling the orginal contract.
