"City of London Corporation v Bovis Construction Ltd", (1992) 3 AllER 697, is likely to become a principal case on the law of noise nuisance. Responding to residents` complaints about building site noise, C served notice under the Control of Pollution Act 1974 s60, restricting the permitted times for noisy operations. The notice was contravened and an injunction was sought and granted. B appealed against the injunction but CA dismissed their case in an important judgment on the application of the 1974 Act.
