In Record v Bell ChD 5 October it was held that where a contract in two parts for the sale of land , signed by the respective parties, was awaiting exchange and the vendor then offered a warranty as to the state of his title in order to induce the purchaser to exchange, the purchaser`s acceptance of that offer could amount to a collateral contract outside the provisions of Law of Property (Miscellaneous Provisions) Act 1989 s2 .
