LT 14 January 1993. In 1988 S issued a cpo under Housing Act 1985 on the claimants property situated in a clearance area. Lack of medical evidence to show a real possibility of claimant returning to live in the property after deterioration of her health together with removal of furniture by relatives and obtaining a void allowance on general rates made it impossible for LT to conclude that W remained in occupation of the property through the relevant period to enable her to qualify for an owner occupier supplement payable under Housing Act 1969 sch 5.
