Re the appeal of Chilton-Merryweather (VO) - 1994 - Rating Appeals 1994 RA 417-421(3) .

LT 23 August 1994. The appeal hereditament had been used as a bank with living accommodation until 1984 when it became the branch office of a building society and is now occupied as offices. It has the external appearance of a bank. It was originally entered into the rating list as offices at £3,150rv; this was reduced to £2,550 following a proposal by the occupiers. VO asked for a reinstatement of the original value based on £33.50 psm on the ground and first floors and £8.25 psm on the basement based on comparables. LT held that the assessment should be increased to £3,150 on the grounds that although the property was in a secondary location competition for the premises would result in the highest bid by an office tenant and that the hereditament should be valued regard to the use of the property at the date of proposal.
